Bailey Glasser Successfully Defends Coal Refuse Disposal Permit
Bailey Glasser continues to lead the field in coal-related environmental permitting matters in Illinois. On February 14, 2017, the Circuit Court of Montgomery County, Illinois, found that Bailey Glasser attorneys Nick Johnson and Jeff Baron, with assistance from investigator John Ailes, successfully defended the issuance of a key coal refuse disposal permit by Illinois Department of Natural Resources (IDNR) to Hillsboro Energy LLC.
In this case, the plaintiffs contended that the refuse disposal area violated both design stability and reclamation requirements under IDNR’s Surface Coal Mining and Reclamation regulations. Bailey Glasser was successful in establishing that the plaintiffs had failed to even meet their initial burden of proof in the matter.
