  • We represented and settled a matter on behalf of a family whose daughter was injured after a delay during her delivery and staff applying aggressive physical force to her head during the delivery. Our clients’ daughter incurred multiple subdural hematomas and cerebellar injuries requiring resuscitation at birth and developed hypoxic-ischemic encephalopathy (HIE) that caused her to experience strokes and seizures. Our investigation revealed that the degree of force used by staff at the hospital was never documented in the records; rather it was documented in text messages between staff. She has permanent neurological injuries and is developmentally delayed as a result.
