Overview

Early in her career, Jennifer Fahey was deeply involved in Bailey Glasser’s environmental and commercial litigation practices. Expanding into the areas of corporate and commercial transactions, Jennifer has spent more than 15 years representing businesses engaged in a broad range of commercial endeavors, with a concentration in the energy and natural resources industries.

Jennifer advises clients on business formation, structure and governance, labor and employment issues, commercial contracts and leases, insurance, and other day-to-day operational matters. In addition, she regularly represents clients in multimillion-dollar commercial deals including complex acquisition, sale and financing transactions; coal, oil and gas production, sale and transportation agreements; private equity projects; carbon credit trading arrangements; and complex commercial disputes.

Experience

Representative Matters

  • Part of the trial team that won a judgment for $19.96 million in favor of Wildcat Coal, LLC, against Bridger Coal Company in a lease dispute over the interpretation of an advance royalty provision.  The October 2023 Order granting judgment can be viewed here.
  • Negotiated a forbearance agreement between the client and a West Virginia coal producer to restructure debt the producer owes to the client and on which it had defaulted
