Representative Matters

  • Obtained, as part of the Bailey Glasser trial team, a verdict in favor of approximately 37,000 Arkansas State Farm customers who suffered a “total loss” of their vehicle.  The jury found that the insurance company breached the contract of insurance when its computer program applied a “typical negotiation adjustment” to comparable vehicles used to determine the “actual cash value” of the wrecked vehicle. The jury also rejected the insurance company’s affirmative defense of estoppel. The verdict form is here. The damages phase is now being conducted consistent with the damages determination made by the jury. The process is expected to return tens of millions of dollars to the 37,000 customers in the class.
