Overview

Todd Myers is a partner in Bailey Glasser’s Lexington office and a member of the firm’s Civil Defense Practice Group. He represents coal, energy, and heavy-industry clients in regulatory enforcement matters, contested administrative proceedings, and high-stakes litigation that follow serious operational events.

Before joining Bailey Glasser, Todd spent more than 26 years as in-house counsel and a law firm litigator for some of the country’s largest mining and mineral development companies. Most recently, he served as VP, Associate General Counsel, and Assistant Secretary at Alliance Resource Partners, L.P. (NASDAQ: ARLP), where he directed enforcement defense, civil litigation, and regulatory compliance across operating subsidiaries in West Virginia, Kentucky, Illinois, and Indiana. He previously spent eight years as Senior Vice President of Risk Management and Associate General Counsel at Blackhawk Mining, LLC, with executive responsibility for litigation, the property/casualty insurance program, occupational safety, and cybersecurity.

Todd’s practice spans the full federal regulatory framework governing mining and other heavy industry clients. He represents clients in Clean Water Act enforcement before the EPA and state environmental agencies, in SMCRA permitting and bond-release proceedings, across numerous states, and in CERCLA and RCRA litigation involving cost recovery and contaminated-site remediation. Todd represents operators in a wide range of matters before the Federal Mine Safety Review Commission. Todd routinely represents clients in governmental investigations, including workplace accidents and human resources compliance, as well as union-represented workforces.

Todd is one of the few practicing lawyers who also hold underground coal mining certification in addition to their bar credentials. He is a certified underground coal miner and certified mine rescue team member in West Virginia, an MSHA instructor with an unlimited rating, and a WVOMHST-certified instructor. That operational fluency lets him engage technical enforcement disputes — ventilation, roof control, haulage, water discharge — on the same footing as the inspectors and engineers across the table.

Todd is admitted to practice in Kentucky, West Virginia, and Virginia. He received his law degree from the Northern Kentucky University - Salmon P. Chase School of Law, where he graduated with honors.
