Military Medical Malpractice

Summary

There has been a historic change in the law, which now allows active duty members of the Armed Forces, to seek compensation for medical negligence against the Department of Defense for injuries and death caused by medical malpractice at DOD hospitals and facilities.

Effective January 2020, individuals who were active members of the military and, who received improper medical care, both within and outside the United States,  can now seek compensation. For the past 70 years, such claims by active military personnel were barred.
